Terms of Service

1. Acceptance

By creating an account or using MaviCats, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the platform.

2. Eligibility

You must be at least 13 years old to use MaviCats. If you are aged 13–15 and located in the European Economic Area (EEA) or the United Kingdom, you confirm that you have obtained parental or guardian consent before registering. By using the platform, you represent that you meet the applicable age requirement.

3. Your Account

You are responsible for maintaining the security of your account. We strongly recommend enabling two-factor authentication (2FA). You must not share your credentials or allow others to access your account.

4. Content Ownership & License

You retain ownership of all photos and content you upload to MaviCats. By uploading content, you grant MaviCats a non-exclusive, worldwide, royalty-free license to host, display, distribute, and cache your content solely for the purpose of operating the platform. This includes displaying your content within Arena challenges where applicable.

This license ends when you delete your content or your account, except where content has been shared by other users (e.g. reposts) before deletion.

5. Prohibited Content

You must not upload, share, or facilitate content that:

  • Is subject to mandatory legal reporting obligations — immediately removed and referred to NCMEC and/or law enforcement.
  • Depicts or promotes illegal activities or violence.
  • Constitutes harassment, bullying, or targeted abuse.
  • Contains unsolicited sexually explicit material.
  • Is spam, scam, or deceptive commercial content.
  • Infringes on someone else's intellectual property rights.
  • Contains malware, phishing links, or attempts to exploit other users.

6. Content Moderation

Uploaded images are subject to automated scanning for safety compliance. Content may be quarantined or removed if it violates these Terms. Users who repeatedly violate these Terms may have their accounts suspended or permanently deleted.

7. Third-Party Photos & Consent

You must have permission to share photos that depict other people, especially minors. If you are a subject of a photo and wish it removed, use the Report button or contact us.

8. DMCA & Copyright

MaviCats respects intellectual property rights and complies with the Digital Millennium Copyright Act (DMCA).

To file a takedown notice, send a written notification to our designated DMCA agent containing:

  1. Identification of the copyrighted work claimed to be infringed.
  2. Identification of the material to be removed (URL or object key).
  3. Your contact information (name, address, email, phone).
  4. A statement that you have a good faith belief the use is not authorised.
  5. A statement, under penalty of perjury, that the information is accurate and you are authorised to act on behalf of the copyright owner.
  6. Your physical or electronic signature.

Counter-notifications: If you believe your content was removed in error, you may file a counter-notification with the same agent. We will restore the content within 10-14 business days unless the copyright holder files a court action.

9. Indemnification

You agree to indemnify and hold harmless MaviCats, its operators, and contributors from any claims, damages, or expenses arising from your use of the platform, your content, or your violation of these Terms.

10. Disclaimer of Warranties

MaviCats is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee that the service will be uninterrupted, secure, or error-free. We are not liable for any data loss, including uploaded images.

MaviCats provides a venue for users to list and discover vintage camera equipment but is not a party to any marketplace transaction. We make no warranties about the accuracy of listings, the condition of items, or seller reliability. Disputes arising from marketplace transactions are solely between the buyer and seller.

All marketplace transactions on MaviCats must be completed through the seller's linked eBay listing. MaviCats does not process payments, hold funds, or mediate disputes. Buyers are protected by eBay Money Back Guarantee; sellers are protected by eBay's seller protections. Soliciting or accepting payments outside of eBay violates our Community Guidelines and may constitute fraud under applicable law.

11. Limitation of Liability

To the maximum extent permitted by law, MaviCats shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform. Where liability cannot be excluded under applicable law, our total aggregate liability for direct damages will not exceed the greater of (a) €50 or (b) the total amounts paid by you to MaviCats in the twelve months preceding the claim.

12. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms. You may delete your account at any time via your security settings.

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be announced via a banner on the platform. Continued use after changes constitutes acceptance.

14. Governing Law & Dispute Resolution

These Terms are governed by the laws of the Netherlands, without regard to conflict of law principles. Any dispute arising from or in connection with these Terms will be submitted to the exclusive jurisdiction of the competent courts in Amsterdam, the Netherlands. If you are an EU consumer, you may also raise a dispute via the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

15. Severability & Entire Agreement

If any provision of these Terms is found invalid or unenforceable, that provision will be limited to the minimum extent necessary and the remaining provisions will continue in full force. These Terms, together with our Privacy Policy and Community Guidelines, constitute the entire agreement between you and MaviCats with respect to the platform and supersede all prior agreements.
